Would you eat at the restaurant right now – regardless of whether you eat indoors or outdoors?
A judge had ruled California's heath director was out of line when she banned outdoor dining last month.
In a ruling handed down Tuesday, Superior Court Judge James Chalfant found the county didn't prove that outdoor dining was dangerous before banning it.
"By failing to weigh the benefits of an outdoor dining restriction against its costs, the county acted arbitrarily, and its decision lacks a rational relationship to a legitimate end," Chalfant wrote in his ruling.
Following Chalfant's orders, the county now has to conduct a risk-versus-benefit analysis before attempting to extend the ban past December 16th.
But outdoor dining cannot open right now because the judge cannot override the state's stay-at-home order.
